Failure to Pay

     Bail bonds issued on Failure to Pay charges, aka Failure to Comply, are generally cash only; in other words, only cash will be accepted for bail. In most cases the court will forfeit any bail posted on behalf of an inmate held on a Failure to Pay charge. However, there are some Arizona courts that will not forfeit the bail as long as the Defendant appears for his hearings.

     Cash-Only Bail Bonds™ can post your Failure to Pay bonds if you are providing the full amount of bail. Unless the Court will allow the cash bond to act strictly as an Appearance Bond, the only way we have of posting your bail will be with your cash or cash equivalent.

     Under some circumstances (weekends, nights, or holidays) we can post our cash for Failure to Pay bonds provided we have substantial collateral in hand and if you have proven cash reserves available once banks open for business. Under the above circumstances our financing of the bond is a very short-term event.

     Most of the Failures to Pay arrests could have been averted if the Defendant would have notified the Court of their inability to make payment on the fine and made an attempt at complying with the Court Order. In other cases, the Court may summons the Defendant to a hearing to explain (Show Cause) why the Defendant has not paid the fine. If the Defendant Fails to Appear, the Defendant will have new charges added to his/her case - Failure to Appear/Failure to Pay. As a general rule the Court will not arrest a Defendant for not having the ability to pay. Failure to Pay is a civil action, Failure to Appear is criminal and forces the Court to issue a warrant.
